GENERAL TERMS AND CONDITIONS – THE AMSTERDAM THROWDOWN

Organizer: Throwdown Events B.V., trading under the name The Amsterdam Throwdown, located in Hoofddorp, the Netherlands (“ATD”).

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • ATD: Throwdown Events B.V.

  • Event: The Amsterdam Throwdown and all related activities

  • Participant: any natural person who registers to participate

  • Visitor: any holder of a valid admission ticket

  • Partner: any sponsor, vendor, or commercial participant

  • Ticket: admission ticket for the Event

  • Force majeure: any circumstance beyond the control of ATD

Article 2 – Applicability

2.1 These terms and conditions apply to:

  • participant registrations

  • ticket sales

  • access to and attendance at the Event

  • participation of partners

  • all legal relationships with ATD

2.2 By registering, purchasing, or attending, the person concerned unconditionally accepts these terms and conditions.

2.3 ATD expressly rejects the applicability of third-party general terms and conditions.

2.4 Deviations are only valid if confirmed in writing by ATD.

Article 3 – Registration and participation

3.1 Participation in the Event is entirely at your own risk.

3.2 The participant guarantees that he/she:

  • is physically and mentally fit

  • is adequately insured

  • is sufficiently prepared

  • complies with the rules of the competition

3.3 ATD is at all times authorized to:

  • to refuse

  • to disqualify

  • remove from the competition

without refund, if:

  • rules are being broken

  • instructions are not followed

  • the safety or integrity of the Event is compromised

3.4 Registration fees are non-refundable, except in cases where ATD decides otherwise at its own discretion.

Article 4 – Tickets and admission

4.1 Tickets are personal (unless otherwise stated) and only grant access on the date(s) specified.

4.2 Tickets are non-refundable and non-exchangeable, except in accordance with mandatory consumer regulations.

4.3 ATD is entitled to refuse or deny access if:

  • fraud is suspected

  • house rules are being violated

  • there is a disturbance of order

  • safety risks arise

4.4 Loss, theft, or misuse of tickets is entirely at the expense of the purchaser.

Article 5 – Program changes

5.1 ATD reserves the right to change the Event or parts thereof, including:

  • program

  • timetable

  • heats

  • location layout

  • competition format

5.2 Such changes do not entitle you to a refund or compensation.

Article 6 – Liability

6.1 Entering the location and participating in the Event is entirely at your own risk.

6.2 ATD shall only be liable for direct damage that is the direct result of intent or deliberate recklessness on the part of ATD.

6.3 ATD is not liable for, among other things:

  • sports injuries or damage to health

  • loss, theft, or damage to property

  • indirect damage

  • consequential damage

  • business interruption

  • lost revenue

6.4 If, despite the foregoing, ATD is held liable, this liability shall be limited to the amount paid out by ATD’s liability insurance.

6.5 If no insurance payment is made, liability is limited to a maximum of the amount paid by the person concerned for participation or admission.

Article 7 – Safety and rules of conduct

7.1 Everyone present is obliged to follow all instructions from:

  • ATD

  • officials

  • crew

  • security

  • location management

to be followed immediately.

7.2 ATD is authorized to remove persons from the premises in the event of:

  • dangerous behavior

  • aggression

  • disruptive behavior

  • violation of rules

  • failure to comply with instructions

7.3 Removal does not entitle you to a refund.

Article 8 – Image rights and media

8.1 Photographs, video recordings, and audio recordings will be made during the Event.

8.2 By participating or attending, the person concerned grants ATD an irrevocable, worldwide, royalty-free license for:

  • recording

  • disclosure

  • multiplication

  • commercial use

of his/her portrait and performance.

8.3 To the extent permitted by law, the person concerned waives their portrait rights.

Article 9 – Force majeure

9.1 ATD is not obliged to fulfill its obligations in the event of force majeure.

9.2 Force majeure shall also include:

  • pandemics

  • government measures

  • license revocation

  • extreme weather conditions

  • infrastructure failures

  • location failure

  • security threats

  • strikes

9.3 In the event of force majeure, ATD is entitled to:

  • to move

  • suspend

  • to adjust

  • to cancel

9.4 In the event of force majeure, there is no right to a full refund, unless ATD decides otherwise.

Article 10 – Vendors and sponsors

10.1 Partners must act in accordance with:

  • laws and regulations

  • safety regulations

  • instructions from ATD

  • location requirements

10.2 ATD is authorized to:

  • change locations

  • limit activations

  • terminate collaborations in the event of breach of contract

10.3 Partners indemnify ATD against claims from third parties arising from their activities.

Article 11 – Privacy and data

11.1 ATD processes personal data in accordance with the GDPR.

11.2 ATD’s privacy statement forms an integral part of these terms and conditions.

Article 12 – Applicable law and jurisdiction

12.1 All legal relationships with ATD are governed exclusively by Dutch law.

12.2 Any disputes shall be submitted exclusively to the competent court in the Netherlands.

Article 13 – Final provisions

13.1 If any provision proves to be invalid, the remaining provisions shall remain in full force and effect.

13.2 ATD is entitled to amend these terms and conditions. The most recent version shall always apply.
